The Most Common Areas Of Law Practice

It should come as no surprise; there are many different types of law. It is up to each individual attorney to decide on which area or areas of law he or she will ultimately practice.

In todays fast paced world, four of the most common areas of practice continue to be personal injury, family law, immigration and criminal defense. Many of the most successful law firms have achieved this success by specializing in litigation and trial strategies, encompassing these areas.

Personal Injury Law. Personal injury law covers MANY types of injuries as well as the worst case scenario, wrongful death. These injuries include but are not limited to: birth injuries, nursing home abuse and neglect, medical malpractice, slip and fall, vehicle accidents (auto, train, bus, ATV, motorcycle, bicycle, airplane) and injuries caused by defective products.

They are caused by the negligence of someone or something and are subject to recoverable damages. The court grants these damages based on facts such as pain and suffering, medical bills, loss of earnings, emotional distress, property damage and lost earning capacity.

Family Law. In many states, family law cases require more court time (and billable hours) than any other kind of case. In reality this area of law covers much more than divorce. It also focuses on prenuptial agreements, domestic violence, separation agreements, property distribution, custody, alimony, child neglect and spousal support.

Family law attorneys are especially mindful of the delicate situations associated with the cases they take on. The feelings of all who are involved are continuously taken into consideration. As a result, struggling families can rest assured that they will receive the best representation possible.

Immigration Law. Because of frequent changes in the law, firms who deal with immigration cases are more than a little knowledgeable on the subject. They have to be.(It is interesting to note that, in the United States, Congress exercises complete authority over immigration laws.)

Immigration law can get quite complicated, depending on the individual situation. Firms practicing this type of law can assist with cases related to: U.S. citizenship, green cards, immigration appeals, visa refusals, business visas, fianc visas, family visas, PERM/labor certification, deportation defense, post conviction relief and more.

Every immigration petition or application should be carefully reviewed before it is submitted to the U.S. Department of Homeland Security. For optimum results, every defense court document should be prepared by a knowledgeable attorney, as well. As the saying goes Better to be safe than sorry.

Criminal Defense Law. Criminal defense is a very important (and sought after) area of law. This is due, in part, to the ever increasing number of individuals who are spending time in prison, for crimes they did not commit.

Since each case is different, criminal defense attorneys must keep abreast of the constant changes occurring with all of the laws that pertain to this area of expertise.

Law firms that handle criminal defense cases can help with drug cases, assaults, hand gun charges, theft, drunk driving, domestic violence, felony charges and sex offences.

Most offer no-cost initial consultations and recommend early intervention, in the event that individuals find themselves faced with the unsettling possibility of conviction, regardless of guilt or innocence.

The issues surrounding each of these areas of law can get very complicated. These cases are rarely cut and dry. For this reason alone, the assistance of a knowledgeable attorney or law firm is imperative.

Legal situations can be (and usually are) VERY stressful. Retaining the right legal counsel can go a long way in relieving this apprehension.

It is important to remember that an attorney or law firm has the best interest of the client at heart and will do everything in their power to rectify a bad situation.

The Law Of Human Attraction Explained

Does a Law on Human Attraction Exist?

-Opposites attract- is a law of attraction, at least where electromagnetism is concerned. But are there laws about attraction between two people? -In a world that is full of strangers- as a line in a famous song of the 1980’s goes, is there a clear set of rules that allows two people to fall for each other?

Is attraction a matter of chemistry?

Maybe. According to scientists, the attraction between animals of the opposite sex is all about chemicals called pheromones. The effect of pheromones in behavior of insects is the most studied to date. It has been observed, at least in some experiments, that pheromones are responsible for communication among same species and colony of ants. The horrible odor released by skunks to ward off enemies is said to be a kind of pheromone. Some species of apes rub pheromone-containing urine on the feet of potential mates to attract them. Some scientists believe that animals (usually the females) such as insects and mammals send out these chemical signals to tell the male of their species that their genes are different from theirs. This gene diversity is important in producing offspring with better chances of survival. The perfume industry has capitalized on pheromones as a means to increase one’s sexual attractiveness to the opposite sex. Animals such as the whale and the musk deer were hunted down for these chemicals.

Lately, scientists are looking into the existence of human pheromones and its role in mate selection. There are many conflicting views in the realm of biology, chemistry, genetics, and psychology. Most scientists would assert that these do not exist, or if they do, do not play a role in sexual attraction between a man and a woman. But new researches such as that conducted by Swiss researchers from the University of Bern led by Klaus Wedekind are slowly making these scientists rethink their stand. Their experiment involved women sniffing the cotton shirts of different men during their ovulation period. It was found out that women prefer the smell of men’s shirts that were genetically different, but also shared similarities with the women’s genes. This, like in the case of insects and other mammals, was to ensure better and healthier characteristics for their future children. But researchers also cautioned that preference for a male odor is affected by the women’s ovulation period, the food that men eat, perfumes and other scented body products, and the use of contraceptive pills.

Does personality figure in sexual attraction?

Yes, but so does your perception of a potential mate’s personality. According to a research conducted by Klohnen, E.C., & S. Luo in 2003 on interpersonal attraction and personality, a person’s sense of self-security and at least the person’s perception of his/her partner were found to be strong determinants of attraction in hypothetical situations. What does this tell us? We prefer a certain personality type, which attracts you to a person. But aside from the actual personality of the person, which can only be verified through close interaction through time, it is your perception of your potential partner that attracts you to him/her, whether the person of your affection truly has that kind of personality or not. This could probably account for a statement commonly heard from men and women on their failed relationships: -I thought he/she was this kind of person.-

So how does attraction figure in relationships?

You have probably heard that attraction is a prelude, or a factor towards a relationship. Most probably, at least in the beginning; but attraction alone cannot make a relationship work. It is that attraction that makes you notice a person from the opposite sex, but once you get to know the person more, attraction is just one consideration. Shared values, dreams, and passions become more significant in long-term relationships.

So should I stop trying to become attractive?

More than trying to become physically attractive, work on all aspects of your health: physical, emotional, mental, and spiritual. Physical attraction is still a precursor. Remember, biology predisposes us to choose the partner with the healthiest genes. Where your emotions are concerned, just ask this to yourself: would you want to spend time with a person who feels insecure about him/herself? Probably not! There is wisdom in knowing yourself: who you are, your beliefs, values, and dreams. And do not pretend to be someone you are not. Fooling another person by making him/her think that you share the same values and beliefs is only going to cause you both disappointments. When you are healthy in all aspects, attractiveness becomes a consequence and not an end. As mentioned in the Klohnen and Luo’s research, a person’s sense of self-security matters, perhaps even beyond attraction. But remember: do these things for yourself and not for other people. Only then can you truly harness your attractiveness as a person.

The Law of attraction Christianity and the five great myths

The law of attraction has received a lot of attention in recent years and many people believe that it is something new or at least “new age”. Nothing could be further from the truth!

Did you know that there are over 200 verses in the bible that support the precepts of the law of attraction and that some of those verses date back almost 3000 years?

What is the law of attraction? Simply put, the law of attraction states that whatever we think, do or say will result in a change in our universe, a change in our personal world, a change in our circumstance. The key here is that all of our words and actions begin with a thought then we make a decision to act or not act on those thoughts. That makes our thoughts extremely important.

The five great myths

Myth #1 The law of attraction is just not Christian. “As a man thinketh, so he is.” is often quoted in articles and discussions about the law of attraction. That quote comes directly from the book of Proverbs 23:7. Clearly this verse states the importance of our thoughts and that our thoughts will make us who and what we are today. That is a fundamental precept of the law of attraction and is supported by the Bible.

Myth #2 Just visualize what you want and it will happen. This statement is wishful thinking at its best. Nothing ever happens without some type of action preceding it. Its a fundamental law of the universe, physics, and nature; nothing is changed or created without some type of action. This law is also clearly supported by the Bible: Galatians 6:7 “Make no mistake: God will not be mocked, for a person will reap only what he sows.” Clearly, if you sow nothing, you will reap nothing.

Myth #3 God wont help you get wealth. The Bible is filled with accounts of righteous, wealthy people. Read the stories of Solomon, Abraham, Isaac, Jacob, Joseph, David and Joseph of Arimathea, the list goes on. Wealthy people in the Bible were NOT condemned for their wealth. Some wealthy people in the Bible were condemned for the way they acquired their wealth, or for not helping the poor. Often times God rewarded righteous people with wealth. God wants us to be abundant in all things. Think for a moment about the following verses:

Second Corinthians 9:8 “Moreover, God is able to make every grace abundant for you, so that in all things, always having all you need; you may have abundance for every good work.”

John 10:10 “I come so that they may have life and have if more abundantly.”

There is not doubt, God wants us to live an abundant life and have abundance in all things.

Myth #4 Money is the root of all evil. First and foremost, the law of attraction is not just about money. It can be applied in every aspect of your life. That being said lets dispel this myth anyway. Money is not the root of all evil. Can you build a church or feed the hungry without money? Can you care for the sick without money? Of course not! If you really want to help the less fortunate, make lots of money and use it to help them. The more you make the more you can help. Here is what the Bible really says: 1 Timothy 6:10 “For the love of money is the root of all evils”

California Lemon Law Aided By Car Buyer’s Bill Of Rights Includes Cooling Off Period For Used Car Bu

California’s lemon law, one of the first in the nation, has now been reinforced by the addition of the Car Buyer’s Bill of Rights. Now, those who buy used cars will be protected against buying used lemon cars.
California was the first state in the country to have passed an auto lemon law in 1982. It has helped many consumers pitted against defective automobiles. If it is not for this lemon law the unfortunate consumer would have had to endure the pain silently. Though the California lemon law is a pioneering legislation and is one of the most powerful and consumer-friendly laws in the country it had had a catch – it did not protect the consumers of used lemon cars. Those who purchased used cars in California were expected to be on their own even if the car had hidden defects and the seller knowingly hid the lethal facts about the car. The consumer of the used lemon car was totally put in dark.
Governor Arnold Schwarzenegger in late July signed the Car Buyer’s Bill of Rights into law.
This turn of events has changed the face of the ways used cars are being sold in California:

Buyers will now have the option of returning a used vehicle to the point of purchase after a two day trial period
Buyers get an opportunity to find any defects or problems with the vehicle that were either unknown or undisclosed

The law originally allowed a buyer to return a car after two days with no charge and no penalty. This, the dealers argued, would tantamount to their borrowing a car for two days for free for a weekend trip, in which case the consumer is saving on a rental car.
In an attempt to further restrict consumers from simply borrowing the car for two days the legislature added in the new law the following rules:

Buyers will pay a fee in order to enable the return privilege
This fee may not exceed $250
Dealers have the permission to charge a restocking fee for any returned vehicle in addition to the upfront fee
A fee is capped at a maximum of $500
This law applies to all used cars of under $40,000, including certified used cars
The vehicle be driven no more than 250 miles during the cooling off period

This legislature added in the new law:

Allows buyers the opportunity to save money
Offers more transparency in the process of selling used cars
Encourages sellers to be more honest about any problems in the vehicles
Reveals defect if the consumer has the right to find it and return it two days later
Protects consumers against the buyer’s remorse if they had bought the vehicle with the undisclosed defects
Protects consumers against fraud
Protects dealers against abuse of their used cars by free loaders Its time similar laws passed in other states too.

Ohm’s Law Animation

Ohm”s law has central importance in the study of electricity. German scientist George ohm established the animation relation between the voltage V and the current I flowing through the circuit due to this voltage. If the current across the conductor is I when the voltage across it is V then the resistance R in animation is given as,

R = ‘(V)/(I)’

The resistance of the conductor is referred as ohm in ohms law animation which contains the 1 ampere current while 1 volt of voltage is applied across it.
Experiment in Ohms Law

The circuit is constructed with variable battery V, A resistance R and a key and the ammeter, voltmeter is connected for measuring the current passing through the circuit and the resistor voltage respectively. The needle like stroke bar is connected to the motorbike. In the place of resistor you can join a small lamp. The ohms law animation is considered as the given circuit,

ohms law
Ratio Calculation of Ohm’s Law

The ratio calculation for the voltage V and the current I provide the value of the resistance. The graph is plotted for the difference in the voltage and the current. The graph is drawn by taking the voltage on the horizontal axis and the current on the vertical axis.

The conclusions for the ratio and calculation by using ohms law in animation is given here,

There is increase in current in linear with the increase in voltage.
The straight line passing through center is obtained in the current voltage graph.
Ratio of the current and the voltage is constant in all the cases.

According to the ohms law, conductor which passes the current is directly proportional to the difference in potential across the conductor.

V ‘alpha’I

V = IR

The R is considered as the constant for the proportionality which gives the resistance of the wire. The resistance now acquires the properties of the metallic wire. The movement of the electrons here is defined for the moving of the electrons and also the atoms of the molecules. The atoms and the molecules attains the collision in the flow of electrons. The electron thus obtained cannot move freely and it is retarded by the resistance of the conductor. The conductors which is considered as good is defined as copper, aluminum. Hence the domestic wiring was done by copper wire.

From the above equation,

Resistance (R) = ‘(V)/(current (I))’ = ‘(V)/(Ampere A)’ = ohm( O).

Here the resistance is measured by using ohm.

Ohms law is probably the most importantl law in electrical subject. It states “The current passes through a element is directly proportional to the voltage applied between the terminal of the same item. In other words we can say that when a voltage is applied across a load, the resulting current is a direct proportion of the voltage. In mathematical notations,

V a I

or, V = RI, where V is the voltage, I is the current and R is a constant. The constant R is defined as the resistance of the circuit.

The concept of Ohms law is very widely used. In this section we will study its application in parallel circuit.

What is a Parallel Circuit:

ohms law parallel

In the above diagram a parallel circuit is shown consisting two resistors having values of resistances as R1 and R2

An electrical source provides a voltage of V which is applied to a circuit consisting two resistors connected in parallel between points A and B.

Applying Ohms law for each branch of the parallel circuit,

V = I1R1 and also V = I2R2
Inferences from Ohms Law in a Parallel Circuit:

As mentioned earlier, the voltage between A and B is same as supply voltage V.

Therefore, as per ohms law,

V = I1R1 or I1 = $ frac{V}{R_1 }$

V = I2R2 or I2 = $ frac{V}{R_2 }$

But the total current I is the sum of the branch currents. That is, I = I1+ I2

Let R be the effective resistance of the entire circuit.

Therefore, $ frac{V}{R }$ = $ frac{V}{R_1 }$ + $ frac{V}{R_2 }$

or, $ frac{1}{R }$ = $ frac{1}{R_1 }$ + $ frac{1}{R_2 }$

Thus Ohms law helps us to find the value of R which is the equivalent resistance of the resistances in parallel.

The total consumption of power of the circuit can also be found

Let the total power consumed P and it is equal to P1 + P2

P1= VI1 and P2= VI2 or as per Ohms law, P1= I12 R1 and P2= I22 R2
